Terms and conditions

Last updated : 2 November 2026

This English version is for convenience only. The Dutch version is legally authoritative. Algemene voorwaarden

In brief

  • Your booking starts when you accept a written quote and pay a 30% deposit.
  • Free reschedule or cancel is possible until 7 days before the session; after that, article 7 applies.
  • Mix and master jobs include 2 revision rounds as described on the service pages.
  • After full payment, neighbouring rights on your recordings sit with you in principle; you warrant rights on samples and lyrics.

1. Scope

These terms apply to all services of Fractaltrail B.V. (private limited company (B.V.)), Overtoom 376A, 1054 JT Amsterdam, KvK 81783584, VAT NL882924515B01 (the studio or we).

The contract consists of the accepted quote plus these terms. Only written deviations in the quote prevail. Accepting a quote means you have read these terms. Browsing the site or sending a message does not bind you yet.

If website languages differ, the Dutch text governs. Company details are in the legal notice.

2. Definitions

TermMeaning
ClientThe person or company accepting a quote.
ConsumerA natural person acting outside trade or profession.
Business clientA client acting in trade or profession, such as a label, agency or company podcaster.
QuoteThe written document describing the service, date, duration, price incl. and excl. VAT, deposit and any special terms.
SessionThe booked time slot in the studio with an engineer.
ServiceVocal recording, Stereo mixing, Mastering, Podcast recording and related work as described on the site and in the quote.
Deposit30% of the agreed price incl. VAT, due when the booking is confirmed.
Business dayMonday to Friday, excluding public holidays in the Netherlands.

3. Pre-contract information

Before you commit, the site and quote show main features of the service, total price incl. VAT (21%), our identity and contact details, and where applicable your right of withdrawal. Service pages such as vocal recording and stereo mixing explain workflow and inclusions.

Indicative hourly rates on the site (for example €98 for Vocal recording or €295 per track for Stereo mixing) are guidance; the quote is binding. For budgeting, see our mix budget guide.

4. Quotes and booking

Requests via contact, phone or email receive a written quote. We aim to reply within 2 business days. A quote stays valid for 7 days unless stated otherwise.

A session or mix/master start date is firmly booked after written acceptance of the quote and receipt of the deposit. Until then, the slot may be offered to someone else.

We may decline a request for a legitimate reason, such as unrealistic timing, safety concerns or incompatible material.

5. Prices

Prices in quotes and on the site are in euros. Consumer prices include 21% VAT unless clearly marked ex VAT; for business clients we also show ex-VAT amounts (e.g. €80.99).

Extra studio time beyond the booked block is charged only if you request it, per started half hour at the quote rate. Out-of-scope work (extra stems, rush delivery, additional edits) happens only after written confirmation.

6. Deposit and payment

When booking, you pay 30% of the agreed price incl. VAT as a deposit, offset against the balance. Payment by bank transfer; card payment in the studio is available for the balance where suitable.

Consumers usually pay the balance on the session day or when final files are delivered for remote work. Business clients pay within 14 days of invoice date unless the quote says otherwise.

Late payment may incur statutory commercial interest and reasonable collection costs for business clients. Until full payment we may withhold final mix or master files; session archives are kept as in article 10.

7. Cancellation and rescheduling by the client

TimingEffect
More than 7 days before the sessionFree cancel or move; on cancel we refund the deposit within 14 days.
Within 7 days down to 72 hours before startThe deposit moves once to a new date within 3 months; without a new date the deposit is forfeited.
Less than 72 hours before start or no-showThe deposit remains due, except proven force majeure on your side.

Send cancellations or moves in writing to [email protected] or confirm by phone in an email. Arriving late shortens the session without extension if the next slot is booked. These rules do not limit statutory withdrawal rights where they apply.

8. Right of withdrawal (consumers)

If you as a consumer conclude a distance contract (email, phone, form), you may withdraw within 14 days without giving reasons, unless a statutory exception applies.

If you explicitly ask us to start before the end of that period (for example a session on a fixed date), you pay a proportionate amount for work already done if you withdraw. For services fully performed at your request before the period ends, withdrawal no longer applies once the service is complete.

Send clear withdrawal to [email protected] or by post to Overtoom 376A, 1054 JT Amsterdam. We refund within 14 days using the same payment method unless you agree otherwise.

9. Studio sessions

The studio is open by appointment according to Tuesday–Saturday 10:00–22:00; closed Mondays (pick-up by appointment).. Up to 6 people fit in the live room at once. Minimum age to book independently is 16; younger participants are welcome with written consent and a parent or guardian present who books and pays.

Treat rooms and gear carefully and follow engineer instructions. No smoking or vaping indoors. We may stop a session if people or equipment are at risk; the booked slot remains due. Damage through intent or gross negligence to studio property is charged to the client. Your own instruments and laptops stay at your risk; insurance is advised.

We use moderate listening levels, breaks and free earplugs. Prepare with our session checklist.

10. Files, delivery and archive

Unless the quote says otherwise, we deliver files in common high-resolution formats (e.g. 24-bit WAV) via a secure download link. Mix and master timelines start when complete, usable source files arrive and count business days.

We keep session and project files for 24 months after the last relevant activity, then delete them unless longer storage was agreed in writing. Download and backup are your responsibility within that window. For streaming or vinyl formats, see our delivery formats guide.

11. Revisions

For Stereo mixing and Mastering, 2 revision rounds are included as on the mix and mastering pages. One round is bundled feedback processed in one pass. Extra rounds or a new artistic direction after approval are quoted separately at €88 per revision hour or a fixed fee in the quote.

12. Liability

We perform assignments with professional studio care. Artistic outcome also depends on your material, preparation and choices; that is not a guaranteed result.

Our liability is limited to direct damage from an attributable breach, except for intent, wilful recklessness or personal injury. For business clients, total liability per assignment is capped at the invoice amount incl. VAT for that job; excluded items include lost profit or missed release opportunities.

These limits do not apply where mandatory law says otherwise.

13. Intellectual property

Your works. Compositions, lyrics and other material you supply remain yours or your licensors’. You warrant you may record, mix or master what you provide, including samples and covers, and handle collective management yourself.

Recordings. When you initiate and pay for recording, you are in principle the producer under Dutch copyright law. To the extent the studio could claim neighbouring rights on recordings made for you, it assigns them to you after full payment.

Performers. Fixing and exploiting performer contributions requires their consent. Obtain written releases for musicians, singers and speakers you bring.

Studio material. Studio demos, templates or stock sounds remain ours unless the quote says otherwise.

References. We use your name or project as a reference only with your written consent. More context: rights and release.

We do not use your recordings to train AI models and do not clone voices without separate written consent.

14. Force majeure

Neither party must perform during force majeure (e.g. power failure, pandemic, major outage, government measure). The affected party informs the other promptly. We reschedule by agreement; if the block lasts more than 28 days or no date works, either party may terminate and we refund unperformed parts.

15. Personal data

We process personal data under the privacy policy. The contact form and email may involve processing outside the EEA via FormSubmit; see also the legal notice. Cookies are covered in the cookie policy.

16. Complaints

Send complaints about an assignment within a reasonable time to [email protected] with quote reference and description. We respond within 2 business days with a proposal. If that fails, consumers may use mandatory consumer rights and dispute options available under law. We do not name a specific arbitration board unless we formally appoint one later.

Practical questions are also in the FAQ.

17. Final provisions

Dutch law applies to these terms and assignments. Consumers may choose courts under mandatory forum rules. For business clients, the Amsterdam district court has jurisdiction unless mandatory law differs.

If a clause is void, the rest remains and we replace it with a valid clause closest to the intent. We may amend these terms; the version published on this page applies as at quote acceptance (last update 2 November 2026, effective 2 November 2026).
